- All New York employers (with some exceptions) must carry workers' comp insurance.
- You do not need to prove your employer was at fault.
- You cannot be fired or discriminated against for filing a claim (Section 120 of Workers' Comp Law).
- Construction workers have additional protections under Scaffolding Law (Labor Law §240).
Where to File
File Form C-2 with the New York State Workers' Compensation Board (WCB). Your employer must file Form C-2F within 10 days of learning of your injury.
